This website (www.azsenatevictory.org) is operated by Arizona Senate Victory Fund (“Arizona Senate Victory Fund,” “we,” “us,” or “our”), a political committee organized under Arizona law. These Terms and Conditions (“Terms”) govern your access to and use of our website, donation platform integrations, text messaging programs, and other digital services (collectively, the “Site”) in connection with our political activities, including fundraising, voter outreach, advocacy, and campaigning on behalf of candidates and causes.

These Terms do not alter the terms or conditions of any other agreement you may have with Arizona Senate Victory Fund. We reserve the right to modify these Terms at any time. Changes take effect immediately upon posting to the Site. Your continued use of the Site after any update constitutes acceptance of the revised Terms. You should review this page periodically.

1. PRIVACY POLICY

Your use of the Site is also governed by our Privacy Policy, available at www.azsenatevictory.org/privacy-policy, which is incorporated into these Terms by reference. The Privacy Policy describes how we collect, use, store, and share information in connection with our political activities, including fundraising, voter outreach, advocacy, and campaigning. 2. PERMITTED USE OF THE SITE

The Site and all content and materials thereon — including Arizona Senate Victory Fund’s name, logo, text, graphics, images, and digital assets (collectively, “Site Materials”) — are the proprietary property of Arizona Senate Victory Fund or its licensors and are protected by applicable U.S. and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-sublicensable, revocable license to access and use the Site and Site Materials solely for your personal, non-commercial use in connection with Arizona Senate Victory Fund’s campaign-related activities. This license does not include:

Any resale or commercial use of the Site or Site Materials
Reproduction, distribution, public performance, or public display of Site Materials except as expressly permitted
Modification of, or creation of derivative works based on, Site Materials
Use of data mining, robots, scrapers, or similar automated data-gathering or extraction tools
Downloading or caching of Site Materials except as permitted by normal browser operation
Any use of the Site or Site Materials other than their intended campaign-related purpose

Any unauthorized use of the Site or Site Materials immediately terminates this license and may violate applicable law, including copyright, trademark, and communications statutes and regulations.

3. INTELLECTUAL PROPERTY

A. Copyright

Unless otherwise indicated, all Site Materials are protected by U.S. and international copyright law. Nothing in these Terms grants any license to intellectual property rights by implication, estoppel, or otherwise beyond the limited license expressly described in Section 2.

B. Trademarks

All names, logos, slogans, and marks displayed on the Site are trademarks or service marks of Arizona Senate Victory Fund, its affiliated committees, or their respective licensors. You may not copy, imitate, or use any such marks, in whole or in part, without prior written permission from Arizona Senate Victory Fund or the applicable mark holder. You may not use any metatags or other hidden text incorporating Arizona Senate Victory Fund’s name, trademarks, or other marks without prior written permission. The overall look and feel of the Site — including page headers, custom graphics, button icons, and scripts — is the trade dress of Arizona Senate Victory Fund and may not be copied, imitated, or used without prior written permission.

C. DMCA and Repeat Infringer Policy

Arizona Senate Victory Fund respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA). In accordance with the DMCA and other applicable law, we reserve the right, in our sole discretion, to terminate access for any user determined to be a repeat infringer of intellectual property rights.

4. HYPERLINKS AND THIRD-PARTY WEBSITES

You may not use Arizona Senate Victory Fund’s logo or other proprietary graphic to link to the Site without express written permission. You may not frame or use framing techniques to enclose any Arizona Senate Victory Fund trademark, logo, or proprietary content without express written consent.

The Site may contain links to third-party websites — including donation processing platforms (such as Anedot) and social media platforms — as a convenience. Arizona Senate Victory Fund makes no representation regarding the quality, content, nature, or reliability of any linked third-party site and is not responsible for their content or practices. The inclusion of any link does not imply affiliation, endorsement, or adoption of the linked site or its content. When you leave the Site, these Terms and our Privacy Policy no longer govern your activity. You should review the applicable terms and privacy policies of any third-party site you visit.

5. USER SUBMISSIONS AND CONTENT

If you submit feedback, questions, comments, suggestions, or other materials to Arizona Senate Victory Fund by email or through any interactive feature of the Site (“Submissions”), you acknowledge that such Submissions are non-confidential. By submitting, you grant Arizona Senate Victory Fund a non-exclusive, royalty-free, perpetual, irrevocable right to use, reproduce, adapt, publish, distribute, and display such Submissions for any lawful campaign-related purpose, without compensation or attribution to you.

If the Site includes any interactive features (such as a blog comment section or petition form), you agree not to post, upload, or transmit content that is:

Unlawful, defamatory, obscene, harassing, discriminatory, threatening, fraudulent, or deceptive
In violation of any third-party intellectual property, privacy, or publicity right
Impersonating any person or entity, or misrepresenting your affiliation with a person or entity
Containing viruses, malware, corrupted data, or other harmful or disruptive code
Unsolicited commercial solicitations or spam
Otherwise objectionable in Arizona Senate Victory Fund’s sole judgment

Arizona Senate Victory Fund reserves the right, but has no obligation, to monitor, remove, or edit any user-submitted content at any time and for any reason without notice. You are solely responsible for any content you submit and for maintaining backup copies of your own submissions. Enforcement of these standards is at our sole discretion and does not constitute a waiver of our right to enforce them in other instances.

6. ACCURACY OF INFORMATION

It is your responsibility to provide accurate, current, complete, and truthful information when using the Site, including when making a contribution, signing up for communications, or volunteering. Arizona Senate Victory Fund is not responsible for any problems or liability arising from inaccurate, incomplete, or outdated information you provide. We reserve the right to reject or remove any submission we believe in good faith to be false, fraudulent, or inconsistent with these Terms.

7. CONTRIBUTION POLICIES

A. Eligibility and Source Requirements

All contributions to Arizona Senate Victory Fund through the Site must comply with applicable Arizona and federal election law. By making a contribution, you represent and warrant that:

Your contribution is made from your own personal funds, not funds provided to you by another person for the purpose of making a contribution
You are not a federal government contractor making a contribution in connection with a federal election
You are not a foreign national lacking permanent-resident (green card) status in the United States
Your contribution is not drawn from the general treasury funds of a corporation, labor organization, or national bank, except as permitted under Arizona law

Both corporate and personal contributions are permitted under Arizona law, subject to applicable source restrictions and contribution limits.

B. Tax Treatment

Contributions to Arizona Senate Victory Fund are not deductible for federal or state income tax purposes. Funds received in response to solicitations are subject to federal and state contribution limits and source prohibitions.

C. Disclosure Requirements

In accordance with Arizona and federal election law and the regulations of the Federal Election Commission (FEC), we are required to make our best efforts to collect and report the name, mailing address, occupation, and employer of individuals whose aggregate contributions exceed $200 per election cycle. By contributing, you authorize us to collect and publicly report this information as required by law. This information may become part of the public record.

D. Contribution Refund and Cancellation Policy

All contributions to Arizona Senate Victory Fund are final. Refunds and cancellations are granted solely at the discretion of Arizona Senate Victory Fund. If you believe an error has been made in connection with your contribution, please contact us promptly at Info@azsenatevictory.org. We will endeavor to work with you to address any such error.

E. Contribution Confirmations

Contribution confirmations will be sent to the email address you provide. It is your responsibility to provide a correct and valid email address. Arizona Senate Victory Fund is not responsible for undelivered confirmations resulting from an incorrect email address.

8. TEXT MESSAGING PROGRAM

Arizona Senate Victory Fund operates a text messaging program for political campaign communications only, including campaign updates, calls to action, and donation requests related to Arizona Republican Senate candidates and causes.

By providing your mobile phone number and opting in to our text messaging program, you expressly consent to receive recurring text messages from Arizona Senate Victory Fund, which may be sent using an automatic telephone dialing system (ATDS) or by manual means. Consent to receive text messages is not a condition of making a contribution or participating in any campaign activity.

Opt-Out: Reply STOP, QUIT, END, CANCEL, UNSUBSCRIBE, or STOP ALL to any text message at any time to opt out. You will receive one final confirmation message after opting out.

Cost: Message and data rates may apply depending on your mobile carrier plan. Message frequency will vary.

Data Sharing: Text messaging opt-in data and consent will not be shared with any third parties for any purpose.

9. DISCLAIMERS

THE SITE AND ALL SITE MATERIALS AND SERVICES PROVIDED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. ARIZONA SENATE VICTORY FUND DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND AS TO THE ACCURACY OR COMPLETENESS OF INFORMATION, CONTENT, OR SITE MATERIALS.

ARIZONA SENATE VICTORY FUND DOES NOT REPRESENT OR WARRANT THAT THE SITE OR SITE MATERIALS ARE ACCURATE, COMPLETE, RELIABLE, CURRENT, OR ERROR-FREE, OR THAT THE SITE OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU SHOULD USE INDUSTRY-RECOGNIZED SECURITY SOFTWARE TO DETECT AND DISINFECT VIRUSES FROM ANY DOWNLOAD.

ARIZONA SENATE VICTORY FUND IS NOT RESPONSIBLE FOR TYPOGRAPHICAL ERRORS OR OMISSIONS IN ANY CONTENT ON THE SITE AND RESERVES THE RIGHT TO CHANGE ANY CONTENT ON THE SITE AT ANY TIME WITHOUT NOTICE.

10. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ARIZONA SENATE VICTORY FUND, ITS AFFILIATED COMMITTEES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR VOLUNTEERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF DATA, OR LOSS OF CONTRIBUTIONS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF OR INABILITY TO USE THE SITE, THE SITE MATERIALS, OR ANY SERVICES OFFERED THROUGH THE SITE, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF ARIZONA SENATE VICTORY FUND HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT ANY LIABILITY IS FOUND, ARIZONA SENATE VICTORY FUND'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE SHALL NOT EXCEED THE AMOUNT OF ANY CONTRIBUTION YOU HAVE MADE TO ARIZONA SENATE VICTORY FUND THROUGH THE SITE WITHIN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply, and you may have additional rights.

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Arizona Senate Victory Fund, its affiliated committees, independent contractors, service providers, and consultants, and their respective directors, officers, employees, and agents, from and against any and all claims, damages, costs, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) any content you submit, post, or transmit through the Site; (b) your use of the Site or any services offered through the Site; (c) your violation of these Terms; or (d) your violation of any rights of any third party.

12. DISPUTE RESOLUTION AND ARBITRATION

Any claim, dispute, or controversy of any kind arising from, relating to, or in any way concerning these Terms, our Privacy Policy, or your use of the Site (“Claim”) shall, at the demand of either party, be submitted to and determined by binding arbitration before a single arbitrator. The arbitration will be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures (including the Expedited Procedures) in effect at the time of the arbitration.

This agreement to arbitrate includes: (i) Claims relating to the enforceability or interpretation of these arbitration provisions; and (ii) Claims relating to Arizona Senate Victory Fund and/or its affiliates, successors, assignees, employees, or agents. All Claims must be arbitrated on an individual basis. Class action arbitration, consolidated arbitration, and representative actions are expressly prohibited.

YOU AND ARIZONA SENATE VICTORY FUND KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE PROCEEDING WITH RESPECT TO ANY CLAIM COVERED BY THIS SECTION.

Judgment upon the award rendered by the arbitrator may be entered in any court of competent jurisdiction. The parties shall maintain the confidential nature of all arbitration proceedings and awards, except as required by applicable law or for the purpose of enforcing an award.

13. GOVERNING LAW

These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict-of-law principles, except where federal law applies (including applicable federal election law and the Federal Arbitration Act).

14. TERMINATION

Arizona Senate Victory Fund reserves the right, in its sole discretion and without notice, to terminate your license to use the Site and to block or prevent your future access to the Site at any time and for any reason, including for violation of these Terms.

15. SEVERABILITY

If any provision of these Terms is held to be unlawful, void, or unenforceable for any reason, that provision shall be deemed severable from the remaining Terms and shall not affect the validity and enforceability of the remaining provisions.

16. CHILDREN’S PRIVACY

The Site is not directed to individuals under the age of 13. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected information from a child under 13, please notify us at Info@azsenatevictory.org and we will promptly delete such information. See our Privacy Policy for additional information.

17. CHANGES TO THESE TERMS

We may modify these Terms at any time to reflect changes in applicable law, our campaign operations, or our practices. Material changes will be posted to the Site with an updated effective date. Your continued use of the Site after any modification constitutes your acceptance of the updated Terms.
